Privacy policy

1. Purpose

This policy applies to all processing of personal data carried out by Moodgie and aims to inform the user about how Moodgie processes personal data (including details on the type of personal data collected and the purpose of processing), as well as the user's rights regarding their personal data.

3. Data Processing – How do we collect personal data?

In accordance with current personal data protection regulations, particularly: The Canadian Anti-Spam Law (CASL) and the Personal Information Protection and Electronic Documents Act (PIPEDA), Moodgie collects personal data when the user: (i) Completes forms on https://moodgie.ca/ ("Site"); (ii) Subscribes to the newsletter; (iii) Responds to a survey or completes an online form; (iv) Fills out a printed form; (v) Sends an email or communicates by phone, later entered into relevant forms.

4. Personal Data Collected – What personal data do we collect?

Moodgie collects information through website interactions, primarily through registration forms. The following data is collected: full name, email address, phone number, date of birth, and mailing address.

Generally, when personal data is required to access a service or content, its provision is not mandatory unless specifically stated. Users can choose not to register or access the service.

The user declares that all provided data is true and accurate and agrees to keep it updated. Changes can be communicated to the Data Protection Officer at the address in section 2 above.

The user acknowledges that the data requested by Moodgie is necessary, appropriate, and not excessive for the stated purposes. False or inaccurate information and any resulting damages are the user's responsibility.

5. Purpose – What is the data used for?

The collected data is used for the following purposes:

  • In case of a service contract on the site, to establish and maintain a commercial relationship and provide Moodgie services (management, administration, delivery, and service improvement).

  • To send newsletters, commercial communications, promotions, and/or advertisements about Moodgie occasionally or periodically. This is based on our legitimate interest to promote our products and services.

  • To conduct surveys or organize contests.

  • To personalize user experience and better meet their needs.

  • To improve the website and Moodgie's service offering based on our legitimate interest to constantly enhance products and services.

  • To process transactions and comply with legal obligations such as tax requirements.

Data will not be used for other purposes unless a compatibility analysis allows it under applicable law. In such cases, users will be informed.

Users may opt out of commercial communications (unsubscribe) by notifying Moodgie via the methods described in section 2 or by following the unsubscribe link in Moodgie emails.

6. How do we use your information?

We use collected data for:

  • Administration

  • User account creation

  • Customer feedback collection

  • Order management

  • Support

  • Dispute resolution

  • Payment processing via Shop Pay and Shopify Payment

If we use your data for other purposes, we will request your consent and only use it for those purposes unless legally required otherwise.

We retain personal information for 60 months after accounts become inactive or as long as necessary to fulfill stated purposes.

7. Consent

By providing personal data to Moodgie, the user fully accepts its processing. The user grants explicit, informed consent to Moodgie for use of collected data as outlined above and inclusion in Moodgie's database.

Moodgie processes user data based on: (i) the service contract, per terms and conditions agreed by checking a consent box; and (ii) explicit, informed consent after reviewing this privacy policy.

Other data processing may be justified by legitimate interest provided it does not infringe on user rights.

8. Retention – How long do we keep your data?

Data will be destroyed or archived when no longer necessary or relevant. Personal data is retained during the commercial relationship and for as long as legal obligations, compensations, or responsibilities may arise.

Moodgie retains essential information for identifying the data's origin throughout the client relationship and/or until consent is revoked, or as long as legally required.

9. Confidentiality / Disclosure / International Transfer – Do we share data with third parties?

Moodgie keeps personal data private and confidential. It is not used beyond stated purposes. Employees and third-party service providers must sign confidentiality and data processing agreements.

Moodgie does not transfer, sell, exchange, transmit, or share personal data with third parties without user consent unless legally required or necessary for service provision. Certain internal departments (administration, marketing, IT) may access personal data.

Moodgie may share user information with affiliates and intermediaries linked to Moodgie.

Moodgie may transfer data to specialized providers when justified by legitimate interest. For example:

  • Maps: Moodgie uses Google Maps, which may collect users’ IP addresses. See Google’s privacy policy: http://www.google.com/intl/en/policies/privacy/.

  • Social Media: Moodgie integrates functions from Facebook and Instagram. These networks have their own privacy policies.

Moodgie may disclose information if required by legal authority, to enforce terms, to comply with law, to protect third-party rights, or for public safety.

10. Security – How do we protect data?

Moodgie takes technical and organizational measures to ensure data security, integrity, and confidentiality per PIPEDA and CASL regulations.

However, absolute privacy cannot be guaranteed. Users acknowledge that no system is impenetrable and that third parties may access data unlawfully. In case of a significant security breach, affected individuals and authorities will be notified promptly.

Moodgie is not liable for user-caused data loss or deletion or for damage caused by viruses. Users are encouraged to take precautions such as using strong passwords and secure browsers.

11. User Rights – What rights do I have?

Users may exercise rights of access, correction, deletion, objection, limitation, portability, and confidentiality under PIPEDA-CASL. Requests may be made by emailing alexandre@collectifweb.ca or writing to joel@moodgie.ca.

Deletion will not occur if it would harm third-party rights or if legal obligations require retention.

12. Training

Moodgie staff involved in data processing are trained to protect personal data and user rights.

13. Third-Party Links

The site may contain links to third-party websites, not affiliated with Moodgie. Moodgie is not responsible for their content, practices, or any resulting damages.

14. Cookies – Do we use cookies?

When visiting the site, Moodgie may store information via cookies. These are used to: (i) Track advertising (ii) Analyze traffic (iii) Improve user experience

Cookies are not required for site navigation except for certain services. Users may delete or block cookies through browser settings.

Cookies are data files used to recognize browsers and capture certain info (e.g., OS, domain, IP). Third-party analytics may be used solely to improve Moodgie services.

15. Approval

Using the site implies full knowledge and acceptance of this Privacy Policy and Moodgie’s terms and conditions. Service requests also constitute acceptance.

16. Updates

This is the current version of Moodgie’s Privacy Policy, last updated on September 16, 2023. Moodgie may modify this policy at any time. Changes take effect upon publication or notification. Users should check this page periodically.
